LABPLAS Tariff Letter

Subject: Important Update: Upcoming U.S. Tariffs on Canadian Goods Effective April 2, 2025

Dear Valued Customer,

This notice is to inform you of developments that may impact your procurement processes. Effective April 2, 2025, the United States government as plan to implement a range of tariff on a broad range of Canadian goods, these tariffs might impact some of the products that LABPLAS INC. (‘’LABPLAS’’) supply to your organisation, as outlined in Executive Order "Imposing Duties To Address the Flow of Illicit Drugs Across Our Northern Border," issued on February 1, 2025.

As a Canadian manufacturer, we wish this situation would have been easier on our trusted network of partners. However, to ensure a continuous flow of products, our legal team wanted me to clarify the following points regarding these tariffs:

  1. Importer of Record: Since our company does not have a direct presence in the U.S., we kindly advise that the importer of record designation be handled by the U.S.-based purchaser or their chosen licensed agent. If some accommodations were easy to advocate under the United States–Mexico–Canada Agreement (USMCA) in the past, we will now no longer be in a position to provide logistics flexibility going forward.
  2. Advancement of Tariff Funds: We cannot advance funds to cover these tariffs. Moreover, in accordance with our General Terms of Sale and our EXW and FCA Incoterms, all customs fees, duties, taxes, and administrative charges are the sole responsibility of the purchaser.
  3. Customs Brokerage: To prevent potential delays or complications in the importation process, we ask for your help, if that is not already the case, that you share the contact information of your licensed customs broker. Providing us with your broker's contact information will help ensure seamless coordination and timely delivery of your orders.
  4. Purchaser Responsibility: As the importer, it is your obligation to comply with all U.S. customs regulations, this includes the payment of applicable obligation and registration, to secure the release any merchandise.

We understand that these changes may pose some challenges, and LABPLAS is committed to supporting you during this hopefully temporary commercial situation.
