AGREEMENT TO OFFICIAL RULES: PARTICIPATION IN THIS SWEEPSTAKES CONSTITUTES ENTRANT’S FULL AND UNCONDITIONAL AGREEMENT TO THESE OFFICIAL RULES. SPONSOR’S DECISIONS ARE FINAL AND LEGALLY BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.
ELIGIBILITY: The Eureka Rewards “(Sweepstakes”) is open to residents of the 50 U.S. including Washington DC, ages 21 and older who are authorized to purchase or recommend the purchase of laboratory supplies and equipment at the time of entry (referred to hereafter as “you” and/or “Entrant”). Employees of Thomas Scientific (the “Sponsor”) or of its parent, subsidiary, affiliated or successor companies; Ventura Associates International LLC (the “Sweepstakes Administrator”) and any advertising, promotional or fulfillment agencies involved in the development or execution of this Sweepstakes (individually and collectively, "Sweepstakes Entities”); or members of their households or immediate families whether related or not; all such individuals are not eligible to participate. "Household members" shall mean people who share the same residence at least three months a year. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. Sweepstakes is subject to all applicable federal and state and local laws and regulations. Void where prohibited by law.
ENTRY PERIOD: Sweepstakes begins at 12:00:00 a.m. Eastern Time (ET) on October 6, 2023 and ends at 11:59:59 p.m. ET on December 31, 2023 (the “Sweepstakes Entry Period"). The Sweepstakes Entry Period consists of three (3) Monthly Prize drawings.
HOW TO ENTER FOR A CHANCE TO WIN: There are two ways to enter. Method 1: (Transaction Entry): An Entrant will receive one (1) entry into the Monthly Prize drawing automatically for which the entry qualifies when a purchase of laboratory supplies and/or equipment of $1,000 or more is made during the Sweepstakes Entry Period. Purchases eligible for Transaction Entry include those made at ThomasSci.com, on a Thomas Scientific eProcurement platform, via phone (by calling 833-544-7447), fax (using fax number 800-345-5232) or email (by using the email address CustomerService@ThomasSci.com). Entry is limited to once per person, per day (regardless of entry method), but you may enter multiple times each month. To qualify for a given Monthly Prize drawing, (i.e., for the months of October, November and December), your order must be received between the first day and the last day of a given month by 11:59 p.m. ET, i.e., “Monthly Entry Period”). Entries resulting from purchases made with lost, canceled, stolen or fraudulent credit cards/payments or returned transactions are void. Orders received via Electronic Data Integration (EDI) are not eligible as Transaction Entries. Method #2: (“Postcard Entry”): To enter the Sweepstakes without making a purchase, write your name, address, phone number, email address and the answer to the question for the month you wish to enter on a postcard. You must also include your answer to the question for the applicable month you wish to enter: Question for the month of October: Thomas Scientific is technically 120+ year old company, in what year did Thomas officially change the name to Thomas Scientific? Question for the month of November: What was the full title of the blog post on August 7, 2023? Question for the month of December: What is the first product block on the top row, displayed in the Laboratory section of the website? All answers are available at www.thomassci.com. Your answer must be correct in order to be eligible to win. Mail your postcard entry to: Eureka Rewards, P.O. Box 20433, New York, NY 10021. All entries submitted via Method #2 must be postmarked by the last day for the month you are entering and received seven days thereafter. For Postcard entries during the month of December, January 2, 2024 will be considered the last day to postmark your entry. Limit: One entry per person per day, regardless of method of entry. Duplicate entries or entries received in excess of entry limit will be disqualified. Entries from any given Monthly Entry Period will not be eligible for subsequent Monthly Entry Periods. Furthermore, if no entries are received for a given Monthly Entry Period, that month’s prize will be awarded from the following month’s entries. Should this situation occur for the month of December, all eligible entries from the month of November will be used to conduct the December drawing. All entries and requests become the property of Sponsor and will not be acknowledged or returned.
Sponsor is not responsible for lost, late, damaged, delayed, garbled, illegible, incomplete, misdirected or postage due entries. Online entries must be made by an individual from a stand-alone computer or mobile device and may not be made by proxy or any electronic/automated means such as script, macro or use of any automated, robotic, repetitive, programmed or similar entry methods or any other similar software or program which will result in disqualification. Entry materials/data that have been tampered, altered or mechanically reproduced or from unauthorized channels are not eligible and will be void. In the event of a dispute as to any online registration, the authorized account holder of the email address used at time of entry will be deemed to be the entrant. The “authorized account holder” is defined as the natural person who is assigned the email address by his/her employer and/or Internet access provider, online service provider or other organization responsible for assigning email addresses as shown on his/her carrier’s records for the domain associated with the submitted address. Winners may be required to show proof of being the authorized account holder. Online entrants subject to all notices posted at www.thomassci.com including but not limited to its privacy policy. Sponsor shall have no liability if notification is lost, intercepted, or not received for any reason. Sponsor is not responsible for any change in winner’s email account or other contact information after entering the Sweepstakes.
WINNER SELECTION & ODDS OF WINNING: MONTHLY PRIZE WINNERS: Monthly winners will be selected in a random drawing from all eligible entries received for a given Monthly Prize drawing within two (2) business days from the end of a given Monthly Entry Period. All random drawings will be conducted by a representative from the Sweepstakes Administrator whose decisions are final. Odds of winning a monthly prize will depend on the number of eligible entries received for a given Monthly Entry Period, estimated at 1: 920.
WINNER NOTIFICATION: Winners will be notified by mail/email and will be required to complete, sign and return an Affidavit of Eligibility & Release of Liability, and where permissible, a Publicity Release (collectively the “Release”) and any other required document request by Sweepstakes Administrator within 7 days from date specified on notification, or the corresponding entry will be disqualified. Three (3) attempts will be made within the seven (7) days notification period to confirm a potential prize winner. If an email notification is returned as undeliverable, or if any winner fails to execute and return any document required by the Sweepstakes Administrator within the time allocated, or if a winner cannot accept prize for any reason (including but not limited to regulations specified by his/her employer, or if he or she is not in compliance with these Official Rules, the corresponding winner will be disqualified and the prize will be awarded to an alternate winner from all non-winning entries pertaining to that given month.
PRIZES AND THEIR APPROXIMATE RETAIL VALUE: Ten (10) prizes will be awarded for each Monthly Drawing. Each winner will receive $100 Reward Choice gift card which can be redeemed for winner’s choice from a list of approximately 366 gift card choices selected by the sponsor. A winner may choose, whether due to his employer's policy or not, to donate the prize to a charity of his or her choice. Prize information will be provided to each winner within 10 business days from the day the winner is verified. Reward Choice gift card must be claimed by and subsequent gift card choice must be made by 12/31/24 or winner will forfeit all rights to the prize. Total ARV of all prizes to be awarded: $3,000.00. No substitution or transfer of any prize to a third party is permitted. Sponsor reserves the right in its sole discretion to substitute any prize for one of equal or greater value. If applicable, all taxes, fees, federal, state, local or other expenses relating to the use/misuse, acceptance and possession of any prize are the sole responsibility of each winner. All terms and conditions of gift card selected by winner shall apply. Except where prohibited by law, by accepting a prize, each winner consents to the use of his/her name, prize won, business name, photograph, likeness, statements and limited biographical information (city and state of residence) for publicity or advertising purposes in all media worldwide, including but not limited to social media, without limitation and without further compensation or notice.
CONSENT AND RELEASE: By participating in the Sweepstakes, Entrants release, indemnify and hold harmless the Sweepstakes Entities and each of their respective parent companies, affiliates, subsidiaries, officers, directors, partners, equity holders, agents, employees, and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”) from and against any and all claims, damages or liabilities with respect to, or in any way arising from or relating to such Entrant's participation or attempt to participate in the Sweepstakes, the ability or inability to upload, download or transmit any information in connection to the Sweepstakes and/or the acceptance or use of the Prize (if applicable), including without limitation liability for personal injury, damages, death, monetary loss, defamation or violation of privacy rights.
No responsibility or liability is assumed by the Sponsor for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, fax or Internet connectivity or other online or network communication problems; errors, omissions or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed, incomplete, inaccurate, damaged, destroyed, misdirected or not received or intercepted transmissions; inaccessibility of any website in whole or in part for any reason; traffic congestion on the Internet or any website; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized access, tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of any email used in connection with the Sweepstakes; any errors, omissions, interruptions, deletions, defects, delays in operation failures or human error that may occur in the transmission, receipt or processing of entries, or for deletion, theft or destruction of, unauthorized access to, or alteration of, entries; causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; any entries submitted in a manner that is not expressly allowed under these Official Rules (all such entries will be disqualified); or cheating or fraud by any Entrant. Sponsor is not responsible for any typographical errors, any incorrect or inaccurate information, whether caused by Entrants, site users, tampering, hacking, or printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on any website. Neither Sponsor, nor the Sweepstakes Administrator are responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer (hardware or software) and/or other device related to or resulting from participation in the Sweepstakes or the acceptance or use of any prize awarded. The use of third-party software or website or automated entry systems to participate is prohibited, and Sponsor reserves the right to disqualify entries made in such fashion. By entering, Entrants agree to comply with these Official Rules. Sponsor is not liable if any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond its control (a “Force Majeure Event”).
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
By participating in this Sweepstakes, each Entrant expressively waives and relinquishes all rights and benefits afforded by California Civil Code 1542 and does so understanding and acknowledging the significance of this waiver. Section 1542 states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DID NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN, BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR THE RELEASED PARTIES.”
ARBITRATION: This Sweepstakes shall be governed by and interpreted under the laws of the State of New Jersey, U.S.A. without regard to conflicts of law provisions. Entrants hereby agrees that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes shall be resolved, upon the election by Entrant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or the American Arbitration Association (“AAA”), as mutually agreed upon by both parties. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and Entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and Entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration.
SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
